Governor signs City of Santa Monica-sponsored state bill on public restrooms for all genders

SANTA MONICA, Calif. — Yesterday Governor Gavin Newsom signed into law Senate Bill 1194, allowing local governments to require public restrooms to be designed as multi-stall restrooms to serve all residents and visitors.

Drafted by Senator Ben Allen, the new state law allows a city or county to require, by ordinance or resolution, that public restrooms built within its jurisdiction meet specified requirements rather than state plumbing standards. ‘State. These standards have, until now, been an obstacle for municipalities converting gender-specific toilets into universal toilets. All gender toilets are more inclusive facilities that benefit everyone, including gender-diverse and transgender people, people who need help from a carer of a different sex, and parents of children under different sexes.

“We are thrilled to have this bill passed into law so that we can provide more inclusive public facilities that serve people of all genders and gender identities, while supporting families and those who need the help of a caregiver,” Mayor Sue Himmelrich said. “Santa Monica was proud to join West Hollywood and Senator Allen in advancing this significant step forward for equity and inclusion.”

City staff will submit an ordinance for consideration by city council in 2023. Once a local ordinance is passed, the city will have the authority to convert existing public restrooms and build new facilities that are universal.
